This Privacy Policy describes the policies and procedures of The Manuscript Club ("we," "us," or "our") on the collection, use, and disclosure of your information, including any Personal Information, when you use our website and services (collectively, the "Service"), and tells you about your privacy rights and how the law protects you.

We use your Personal Information to provide and improve the Service. By accessing or using the Service, you consent to the collection, use, transfer, storage, and disclosure of your information as set out in this Privacy Policy. This Privacy Policy is incorporated into and subject to The Manuscript Club Terms of Service.

1. Interpretation and Definitions

For the purposes of this Privacy Policy:

  • Account means a unique account created for you to access our Service or parts of our Service.
  • Company (referred to as "we," "us," or "our") refers to The Manuscript Club, 244 Queen St, Ottawa, ON K1P 5V9, Canada. For the purposes of the GDPR, the Company is the Data Controller.
  • Cookies are small files placed on your computer, mobile device, or other device by a website, containing details of your browsing history on that website among other uses.
  • Personal Information (or Personal Data) means any information that relates to an identified or identifiable individual, such as a name, email address, identification number, location data, or online identifier.
  • Service refers to the website, accessible from https://themanuscriptclub.net, and the services, features, content, and applications we offer.
  • Service Provider means any natural or legal person who processes data on behalf of the Company, such as third-party companies employed to facilitate the Service, provide it on our behalf, or assist us in analyzing how it is used. For the purposes of the GDPR, Service Providers are Data Processors.
  • Usage Data refers to data collected automatically, either generated by use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
  • You means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service.

2. Information We Collect

2.1 Personal Information You Provide

While using the Service, we may ask you to provide certain personally identifiable information that can be used to contact or identify you, including but not limited to:

  • Email address
  • First name and last name
  • Address, province/state, postal/ZIP code, city
  • Account and profile information you choose to provide
  • Content you submit to the Service, such as book information, covers, descriptions, and review confirmations

2.2 Usage Data

Usage Data is collected automatically when you use the Service. It may include your device's IP address, browser type and version, the pages you visit, the time and date of your visit, time spent on pages, referring/exit pages, operating system, clickstream data, unique device identifiers, and other diagnostic data. If you access the Service through a mobile device, we may also collect the device type, unique device ID, mobile operating system, and mobile browser type.

We use this information to analyze trends, administer the Site, monitor and improve the Service, fight spam and malware, and gather broad demographic information for aggregate use.

2.3 Account Security Data

When you sign in to your Account, we automatically collect and store certain information for account security and fraud prevention, including the IP address from which you sign in, the date and time of each sign-in, and the total number of sign-ins. We use this information to detect unauthorized access, prevent fraudulent activity, and maintain the security of the Service.

2.4 Information from Third-Party Sign-In Services

If we allow you to create an account or log in through a third-party service (such as Google or Facebook) and you choose to do so, we may collect Personal Information already associated with that account, such as your name and email address. By providing such information, you give us permission to use, share, and store it in a manner consistent with this Privacy Policy.

2.5 Financial Information

We use third-party payment processors (such as Stripe) to collect and store payment information. We do not store or collect your payment card details. That information is provided directly to our payment processors, whose use of your information is governed by their own privacy policies. These processors adhere to PCI-DSS standards. We may from time to time receive limited financial information from our payment processors for the purposes of completing transactions, detecting fraud, and managing our business.

2.6 Cookies and Tracking Technologies

We use Cookies and similar tracking technologies (such as web beacons, tags, and scripts) to track activity on the Service and store certain information. We use both Session and Persistent Cookies for the following purposes:

  • Necessary / Essential Cookies — to authenticate users, prevent fraudulent account use, and provide requested services.
  • Functionality Cookies — to remember choices you make (such as login details or language preference).
  • Tracking and Performance Cookies — administered by third parties, to analyze traffic and how users use the Service, and to test new features.

We may use analytics providers such as Google Analytics, which uses cookies to collect information that may be transmitted to and stored on servers in other countries. You can opt out of Google Analytics using Google's opt-out browser add-on. We may also use security services such as Google reCAPTCHA, which may collect information from you and your device for security purposes.

You can instruct your browser to refuse all Cookies or indicate when a Cookie is being sent; however, if you do not accept Cookies, you may not be able to use some parts of the Service.

3. How We Use Your Information

We may use your Personal Information for the following purposes:

  • To provide, maintain, personalize, improve, and operate the Service, including monitoring usage;
  • To manage your Account and registration as a user;
  • To perform our contract with you, including processing subscriptions and purchases;

  • With Service Providers — to monitor and analyze use of the Service, process payments, host the Service, send emails, and contact you. Service Providers may only use your information as necessary to perform services for us.
  • For business transfers — in connection with, or during negotiations of, any merger, sale of Company assets, financing, acquisition, insolvency, bankruptcy, or receivership, in which Personal Information may be among the assets transferred. Any acquirer may continue to use your Personal Information as set forth in this Privacy Policy.
  • With affiliates and business partners — in which case we will require them to honor this Privacy Policy.
  • With other users — when you share information or interact in public areas of the Service (such as your reviewer or publisher profile, book listings, or public activity), that information may be viewed by other users and may be publicly distributed. Search engines may index public information, and individuals reading it may use or disclose it without our control.
  • For legal reasons and protection — we reserve the right to access, read, preserve, and disclose any information we reasonably believe is necessary to (i) comply with applicable law, regulation, legal process, or lawful requests by public authorities; (ii) enforce this Privacy Policy and our Terms of Service, including investigating potential violations; (iii) detect, prevent, or address fraud, security, or technical issues; (iv) respond to support requests; or (v) protect the rights, property, or safety of The Manuscript Club, our users, or the public.
  • With your consent — for any other purpose disclosed to you.

We do not use IP addresses to identify you personally or disclose them publicly, though we may share them with our partners and Service Providers for the purposes specified in this Privacy Policy.

Aggregate Information

We may collect and share statistical, aggregated, or anonymized information about how users use the Service. This information does not identify you personally and may be shared with partners and Service Providers.

5. Retention of Your Information

We retain your Personal Information only for as long as necessary for the purposes set out in this Privacy Policy, including to comply with our legal obligations, resolve disputes, and enforce our agreements and policies. Usage Data is generally retained for a shorter period, except where used to strengthen security or improve functionality, or where we are legally obligated to retain it longer.

Account Security Data (sign-in IP addresses, timestamps, and sign-in counts) is retained for twenty-four (24) months from collection or until your Account is deleted, whichever occurs first.

Content you submit to the Service may be retained as long as necessary under applicable law, even after Account termination, and may continue to be disclosed in an anonymized manner. Public activity on your Account prior to deletion may remain stored on our servers.

6. International Transfers of Your Information

Your information, including Personal Information, is processed at our operating offices and in any other places where the parties involved in processing are located. This means your information may be transferred to — and maintained on — computers located outside of your province, state, or country, where data protection laws may differ from those of your jurisdiction. Government and law enforcement agencies of those jurisdictions may be able to access such information in accordance with their laws.

Your consent to this Privacy Policy followed by your submission of information represents your agreement to such transfers. We will take all steps reasonably necessary to ensure your data is treated securely and in accordance with this Privacy Policy.

7. Access, Correction, and Deletion of Your Information

You have the right to access, correct, amend, or delete the Personal Information we hold about you.

  • Registered users can access and update information associated with their Account by signing in and visiting account settings.
  • You may also contact us at support@themanuscriptclub.net to request access to, correction of, or deletion of your Personal Information.
  • When you request deletion of your Account or Personal Information, we will delete associated Account Security Data, including sign-in IP addresses, timestamps, and sign-in counts.

Please note we may need to retain certain information where we have a legal obligation or lawful basis to do so — for example, email addresses, network logs, or records related to fraudulent or illegal activity. To protect your privacy, we may take reasonable steps to verify your identity before updating or removing information. Your ability to access or correct information may be temporarily limited where doing so could inhibit our ability to comply with a legal obligation, investigate or defend legal claims, disclose information about a third party, or breach a contract or disclose proprietary information.

8. Your Choices

  • You can navigate most of the website without providing Personal Information, though some features require registration.
  • You may opt not to disclose certain information, even though it may be needed to use some features.
  • You may opt out of marketing emails at any time by following the unsubscribe link in any email we send or by contacting us. Opting out of promotional email does not affect service-related, transactional, or legal communications, and we reserve the right to contact you for informational or account-related purposes when necessary.

9. Security of Your Information

The security of your Personal Information is important to us. We employ a variety of commercially reasonable security technologies and measures intended to protect your information from unauthorized access, use, or disclosure, and our personnel are required to handle Personal Information in accordance with our security protocols and standards of confidentiality.

However, no method of transmission over the Internet or method of electronic storage is 100% secure. We cannot fully eliminate security risks, and mistakes and security breaches may occur. We do not guarantee or warrant that our security measures will prevent unauthorized access to your information.

10. Canadian Privacy Rights (PIPEDA)

If you are a resident of Canada, we collect, use, and disclose your Personal Information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation. You have the right to access your Personal Information, challenge its accuracy and completeness, and withdraw consent to its collection, use, or disclosure (subject to legal or contractual restrictions and reasonable notice). You may also file a complaint with the Office of the Privacy Commissioner of Canada regarding our handling of your Personal Information.

11. GDPR Privacy (EU/EEA and UK Users)

11.1 Legal Bases for Processing

We may process Personal Data under the following conditions: your consent; performance of a contract with you; compliance with a legal obligation; protection of vital interests; public interest; and our legitimate interests (including preventing fraud, detecting unauthorized account access, and maintaining the security of the Service).

11.2 Your Rights

If you are within the EU, EEA, or UK, you have the right to: request access to your Personal Data; request correction of incomplete or inaccurate data; object to processing based on legitimate interests or for direct marketing; request erasure of your Personal Data where there is no good reason for continued processing; request transfer of your Personal Data in a structured, commonly used, machine-readable format; and withdraw your consent at any time.

12. California Privacy Rights (CCPA/CPRA)

If you are a California resident, you have specific rights regarding your personal information, including: the right to notice of the categories of personal information collected and the purposes of use; the right to know/access the personal information we have collected about you; the right to correct inaccurate personal information; the right to request deletion of your personal information, subject to certain exceptions; the right to opt out of the sale or sharing of personal information; the right to limit the use and disclosure of sensitive personal information; and the right not to be discriminated against for exercising your rights.

We collect categories of personal information including identifiers (such as name, email address, and IP address), customer records information, commercial information (such as subscription history), and internet or network activity. We do not sell personal information as the term is commonly understood; however, we allow Service Providers to use your information for business purposes such as analytics, and some such activities may be deemed a "sale" or "sharing" under the CCPA/CPRA. We will respond to verifiable consumer requests within 45 days, extendable once by an additional 45 days with notice.

Our Service does not respond to "Do Not Track" signals.

13. Children's Privacy

Protecting the privacy of children is especially important. Our Service is a general audience service not directed to anyone under the age of 18, and users must be at least 18 years old under our Terms of Service. We do not knowingly collect Personal Information from children under 13 (or the applicable age of consent). If you are a parent or guardian and believe your child has provided us with Personal Information, please contact us, and we will take steps to remove that information from our servers.

14. Links to Other Websites

Our Service contains links to third-party websites that are not operated by us, including Amazon. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services. We strongly advise you to review the privacy policy of every site you visit.

We may update this Privacy Policy from time to time. Changes will be posted on this page, and we will update the "Last Updated" date at the top. Where changes materially alter your rights or obligations, we will make reasonable efforts to notify you — for example, via email or a prominent notice on the Service — before the change becomes effective. You are bound by any changes to this Privacy Policy when you use the Service after such changes have been posted, and you are advised to review this Privacy Policy periodically.
